Consultant to Develop Legal Advice Sheet Terms of Reference (TOR)

  1. Introduction and Background

Sahmakum Teang Tnaut (STT) is located in Phnom Penh. STT was founded in 2005 and officially registered in 2006 as a local NGO supporting urban poor communities. “Teang Tnaut” means “Palm Leaves” and palm leaves are used by poor communities, to build rooves, and walls for their houses. This simplistic name was chosen to forever remind STT that its work serves the poorest members of society. STT started as a small NGO that focused on technical upgrades in poor communities but over the past decade, many communities have been affected by development, land transfers, and evictions. As a result, STT has since grown to produce community maps, research and advocacy in order to achieve its goal of helping poor communities realize their rights to land and housing. STT’s efforts in Phnom Penh alone have reached 270,000 people. STT and its partners have helped communities express their concerns to national and international media, donors as well as national and international NGOs.

  1. Objective

The purpose of the consultancy is to update the existing legal advice sheet in order to reflect new laws and policies that have been implemented in Cambodia.  The legal advice sheet is used as a template for providing legal support to urban poor communities. The existing template has six categories and STT staff fill in each category based on information catered to the unique situation of each househould..

  1. Expected Results and Deliverables
  • Before commencement of work the consultant is required to submit a final proposal including methodology, support strategy, work plan and budget, to STT.
  • The consultant will review and provide feedback on STT’s existing legal advice sheet
  • The consultant will draft recommendations for updates to the legal advice sheet
  • The consultant present their feedback to relevant staff
  • Reports of the progress of the consultancy with verbal updates of progress as appropriate.
  • Finally, the consultant will update STT’s existing legal advice sheet
  1. Methods and Activities

The consultant will provide STT with the following:

  • Updated legal advice sheet
  • Presentation of recommendations on STT’s existing legal advice sheet
  • Relevant laws and documents as soft copy to STT
  • Summary of legal documents which are relevant to STT’s legal advice sheet.

2. Objective

The purpose of the consultancy is to create an Occupational Health and Safety Policy for STT. The occupational safety and health policy will define the goals for the occupational health and safety work in the workplace and for activities that promote the working capacity of STT staff. The policy will also describes occupational health and safety responsibilities and the way of organizing the cooperation measures.

 

3.Expected Results and Deliverables

– Before commencement of work the consultant is required to submit a final proposal including methodology, support strategy, work plan and budget, to STT.
– One Occupational Health and Safety Policy will be developed as well as a summary factsheet which will contain key messages to be disseminated to all staff.
– Reports of the progress of the consultancy with verbal presentation of progress as appropriate.
– An Occupational Health and Safety training session to all STT staff which will highlight the purpose of the policy and key health and safety considerations for the workplace .

The consultant will provide STT with the following:
– Develop Organizational Health and Safety Policy.
– Provide training to all STT staff members.
– Receive comments from STT Management.
– Submit the final policy and a summary factsheet.

Main Responsibilities

  1. Media & ICT Project Management: Support the project manager in all aspects of project management, including reporting and budgeting. Responsibilities with regards to specific activities include:
    – Develop and conduct training session on social media advocacy that are highly participatory and have practical outcomes.

    – To evaluate the effectiveness of training and modify materials as appropriate

Requirements

The post holder is expected to have:
– Degree in ICT, Computer Science or other related fields
– 02-year experiences in community training related to technologies, or social medias
– Good communication skills in Khmer and English
– High computer literacy and ability to utilize various media to enable the voices of people living in poverty be heard.
– Networking skills to enable STT to be widely known across communities under threat of eviction in Phnom Penh as well as with NGOs working with these communities.
– The ability to work well in a team and to lead the team in producing high quality outputs for a range of audiences.

Consultant to Conduct Strategic Plan Mid-Term Review Terms of Reference (TOR)

1. Introduction and Background

STT is a Cambodian Urban NGO working with vulnerable urban poor communities, in Phnom Penh and the provinces, who are affected by land and housing rights issues. STT is implementing four related projects: 1) Community Mapping, Housing Improvement and Urban Resilience Project; 2) Housing Rights and Research Project; 3) Community Empowerment Project; and 4) Community Media and ICT Project. Each year to support the advocacy work of STT and other partner organisations, STT undertakes research into key issues affecting urban poor communities under threat of eviction. STT also has a strong focus on strengthening the advocacy capacity of community activists and providing a number of social media, ICT and land and housing rights trainings to urban and rural communities.

The Strategic Plan (2019-2023) provides a coherent programmatic planning framework by leveraging STT’s strengths and capacities. STT’s core values include transparency and accountability, as a result, this assignment will be undertaken in order to uphold STT’s commitment to its core values, by improving the organization’s ability to provide maximally effective assistance to its target beneficiaries.

2. Objective

The purpose of the mid-term review is to ensure that STT’s projects are in line with STT’s 5- year Strategic Plan which was developed in 2019 and to highlight the strengths and weaknesses which exists in STT’s overall strategy by analyzing the level of impact STT’s projects have made on urban poor communities.

3. Expected Results

The mid-term review will be a participatory exercise to assess the performance of STT’s projects. It has an objective of mainly internal learning for the areas of implementation and results and is intended to inform operational decision-making and adjustments to on-going projects. Findings and recommendations will inform annual operational planning exercises, in order to help STT to reflect on its projects and ensure that timely improvements are made, in order to meet the proposed targets by 2023.

Therefore, the expected results are:

– To provide STT with an independent, evidence–based and participatory evaluation focusing on the impact of the current projects on urban poor communities, while including some target groups from previous projects to inform on the longer-term impact of STT’s interventions.
– To assess how the current projects contribute to, and fit with STT’s overall strategy.
– To provide STT with recommendations on how to adjust the strategic plan in order to maximize impact and meet the needs of vulnerable urban poor communities beyond June 2021 at the strategical levels.

A special focus is to be put on the impacts of Covid-19 and the changing political climate on the organization and on the inclusion of the longer term coping strategies.

4. STT’s Intervention Strategy

STT’s mission is to develop advocacy tools, empower, and support urban poor and vulnerable communities to obtain adequate and comfortable housing. To do so, STT decided to work toward the achievements of four strategic objectives by the end of 2023, three of which are aimed at serving target communities:

  1. Urban poor and vulnerable communities supported by STT will have increased security in land tenure, in which they can legally manage, utilize, and benefit. It refers to component
  2. Urban poor and vulnerable communities supported by STT will have increased confidence and ownership, especially women, and actively initiate, negotiate, mobilize, and organize their own advocacy activities to demand their land and housing rights, and as a result, they will receive positive responses from respective stakeholders.
  3. Urban poor and vulnerable communities supported by STT will have improved housing conditions with appropriate infrastructure and better community environments and hygiene.

To implement its program strategies and activities, STT employs the following main approaches:

  1. Community-led development: support communities to set their own local goal and priorities by encouraging/involving them to initiate and make own decisions on planning, and take part in monitoring the actions.
  2. Evidence-based advocacy: provide reliable information and evidences such as maps, research report/data, alternative plans… to communities to use as tools for advocacy activities.
  3. Capacity development: enhance capacity (knowledge, skills, attitudes, and experiences) regarding land and housing rights in order to build their confidence in advocacy.
  4. Media and communications use: use all possible media types (ICT/social media, radios, press…) to spread community advocacy messages (voices, concerns, demands) to wide audience (including decision-makers).
  5. Networking: connect communities with each other in order to mobilize strong and common voices to advocate together influencing changes.

5. Proposed Methodology

The proposed methodology is as follows:

Briefing session with STT;

– Desk review of the existing project documents
– A participative methodology is highly recommended in order to take into account the opinion of all partners and stakeholders;
– Use of mixed methods including semi-structured interviews of key informants (including project staff and relevant management staff, STT’s Board of Directors, project funding partners, NGOs working on similar issues and national or subnational authorities, etc.) and focus group discussions with people and communities targeted by the project;
– Interview with other NGOs working on urban issues in Cambodia.

The consultancy will last for 2 months, starting from 1 July 2021 and going until 31 August 2021.

 7. Evaluation Outputs

Final output is expected in report format, which should adhere to STT’s standard format.  The report should be submitted in English and Khmer and should be of high quality to share with outside agencies, donors or interested third parties.  It should be structured according to STT’s format in terms of issues and related findings, assessment of performance, description of best practices, conclusions and recommendations.

Additional outputs include a PowerPoint presentation on key findings and a draft report to be circulated in stakeholder meetings.

8. Experience and Qualifications/Awarding Criteria

The assignment will be contracted to consultants with substantive experience in the area of civil society and knowledge of land and housing rights in urban settings. Given the current context, the consultants must be based in Cambodia.

Education

A minimum of a Bachelor’s in sociology, international development, social sciences, management or other relevant field of study.

Work experience

– Minimum 5 years of experience in management of program, implementation / evaluation of projects/programmes;
– Solid understanding of urban issues and land & housing rights;
– Knowledge and experience of land and housing rights, evidence-based advocacy in urban settings;
– Excellent analytical and report writing skills;
– Good people and communication skills;
– Proven work experience in use of participatory evaluation methods for identifying measurable target indicators;
– Demonstrated ability to assess complex situations in order to succinctly and clearly distil critical issues;
– Must be able to work independently with excellent demonstrated teamwork, coordination and facilitation skills;
– Experience in leading multi-disciplinary teams to deliver quality products in high stress and short deadline situations;
– Ability to work in a multicultural team environment and to deliver under pressure/meet deadlines
– Comfortable with the necessary computer skills i.e. MS Word (personal laptop will be necessary for this mission)
– Impartial and independent of the parties

Languages

Fluency in English language required. Fluency in Khmer is an advantage but not mandatory.

9. Budget and Payment terms/schedule

The total available budget for this mid-term review is USD 7,500 including 15% of withholding tax. The consultant team is requested to submit a research proposal which consists of appropriate study design and budget breakdown. The payment to the successful consultant will be made in three installments:

– 20% upon contract signing

– 40% upon presentation of key findings

– 40% after submission of the final report

  1. Background

Phnom Penh is the largest and most developed city in Cambodia, with many urban residents enjoying its benefits as it grows and becomes more modern. However, despite recent development, urban poor communities often complain that the development of the city is leaving them behind. The scale and depth of poverty is underestimated by most governments and international agencies, and this helps underpin ineffective policies. This is made worse by the lack of voice for low-income urban dwellers and their lack of influence within governments and aid agencies. In today’s world, most of the economy and more than half the population are now in urban areas. Urban poor communities live in informal settlements, most of which are affected by inadequate housing, risk of forceful eviction, lack of safe drinking water, poor sanitation and drainage, lack of solid waste management, lack of access to healthcare and high risk of disasters and with risk levels increasing because of climate change. Most definitions and measurements of poverty take none of the above into consideration, as they are based only on income-levels. And income-based poverty lines are usually set too low in relation to the costs of food and non-food needs for urban populations.

This study will focus on providing an overview of urban poverty in Phnom Penh and compare it to Cambodia’s overall rank in the Global Multidimensional Poverty Index. The central role of local governments and representative organisations and federations of the urban poor in reducing urban poverty will be recognized and the recommendations provided will encourage local governments to change their approaches. The study also aims to produce knowledge on how community-led interventions (such as improving security of tenure and access to basic services) can grow into inclusive city-wide programmes and obtain a better understanding of how women, men and children view poverty, and of how they develop their priorities. Lastly, international organizations, banks and donors will be consulted to obtain a better understanding of why urban rather than rural poverty can be a challenge for funding and ways in which funds can be channelled into projects benefiting the urban poor.

– To review and assess bilateral and multilateral funding projects targeting the urban poor.
– To identify any risks relevant to policy level with all actors in terms of urban poverty.
– To obtain an understanding of reasons for migration to Phnom Penh from rural areas.
– To make clear recommendations to stakeholders on how projects can be targeted for the urban poor communities on the basis of the findings of this research.
– To identify any evidence of improvement or deterioration in living conditions in urban poor communities

1. Introduction and Background

Sahmakum Teang Tnaut (STT) is located in Phnom Penh. STT was founded in 2005 and officially registered in 2006 as a local NGO supporting urban poor communities. “Teang Tnaut” means “Palm Leaves” and palm leaves are used by poor communities, to build rooves, and walls for their houses. STT is looking to hire an external consultant to develop a community database in order to present data from the urban poor communities in Phnom Penh, in an engaging manner and to provide easy access and downloadable content for the public.

2. Objective
The purpose of this consultancy is:
to develop a functional and accessible internal community database, with publicly accessible components
to develop a database manual which consists of guidelines including key troubleshooting approaches,catered to both technical and non-technical persons;
to provide training to technical staff so that they are able to update and maintain the database on their own.

3. Methodology
–  Develop community database through an online platform.
 Prepare data and information following the template provided by STT.
 Produce progress reports with verbal presentations of as appropriate.
Receive comments from STT’s Management.
Prepare a final report on work undertaken and presentation to relevant staff and stakeholders.
Provide training to STT’s technical staff on the whole process of community database building, maintenance and updates.

4. Expected Results and Deliverables

The document also serves as a guideline for administrators and users.

3. Methods and Tools

– Consultant will produce three advocacy videos
– The concept of the videos will either be provided by STT or proposed by the consultant
– Stories, photos, videos, images, audio, infographics and other materials related to the process of producing the video will be developed by the consultant

– The full work plan and timeline will be developed by the consultant and approved by the STT team before commencement of work

Duties

Consultant to Develop the Interactive Map – Terms of Reference (TOR)

1. Introduction and Background
STT is a Cambodian Urban NGO working with vulnerable urban poor communities, in Phnom Penh and the provinces, who are affected by land and housing rights issues. STT is implementing four related projects: 1) Community Mapping, Housing Improvement and Research Project, 2) Land and Housing Rights Project, 3) Community Empowerment Project, and 4) Community Media and ICT Project. Each year to support the advocacy work of STT and other partner organizations, STT undertakes research into key issues affecting urban poor communities under threat of eviction. STT also has a strong focus on strengthening the advocacy capacity of community activists and providing a number of social media, ICT and land and housing rights training to urban and rural communities.
STT is looking to hire an external consultant to develop interactive maps for Phnom Penh’s main lakes map in order to present the information through an engaging medium and allow the public to easily access and download.

2. Objective ​
The purpose of this consultancy is to develop interactive maps of Phnom Penh’s main lakes and provide training to technical staff so that they are able to update and maintain the maps on their own.

Phnom Penh based Sahmakum Teang Tnaut (STT) is a Cambodian Urban NGO set up in September 2005 and officially registered with the Ministry of Interior in December 2006. Job Responsibilities:

Main responsibilities, Tasks and Activities

  1. Project Management: Assist the Project Manager in project management in term of project planning, organizing, leading, and monitoring and evaluation.
  2. Project Implementation: Under supervision of Project Manager, undertake specific activities including:
  • Community monitoring: To monitor target communities’ event and other case of land conflict.
  • Community Profiling: To write and produce profile of community and other report of land conflict.
  • Community Mapping: To assist participatory mapping activities and help to produce hand-drawn and digital maps and other information working alongside the other team and communities.
  • Community Survey: To participate designing and complete surveys of target communities working with STT staff and assist collaboration with communities and local authorities.
  • Legal Analysis: To collate and analyze data collected through surveys, interviews and other means and support to write legal advice sheet with exiting template.
  • Workshop, Training, Meeting: To involves, assists and organizes any trainings, meetings and workshops in relation to project implementation under instruction of Project Manager.
  1. Project Innovation: To keep abreast of technical development in project fields and to maintain an overview of the social and political climates affecting contact communities.
  2. Other Project and Tasks: To assist other project tasks and other additional tasks as required by other Managers and/or Management Committee.

Skills and Qualification

The post holder is expected to have:

  • Bachelor Degree of Law, Human Rights, Social Science, Urban Planning, Environment, Mapping, or other related fields
  • Minimum 02 years working experiences in community development
  • Good communication skills with a range of stakeholders including communities, representatives of other NGOs, and colleagues.
  • Excellent organization skills and be able to manage the logistics of organizing meetings and hearing the voices of people living under threat of eviction.
  • Computer literacy and be able to produce useful data for the Community Project Coordinator and members of the Management Committee.
  • Networking skills to enable STT to be widely known across communities under threat of eviction in Phnom Penh as well as with NGOs working with these communities.
  • Analytical skills and the ability to gather information from a variety of sources to assist in the production of clear, concise reports.
  • The ability to lead a small team and to produce high quality outputs.

Consultant to Develop the Training Manual (for trainers) and Training Booklets (for communities) Terms of Reference (TOR)

1. Introduction and Background

STT is a Cambodian Urban NGO working with vulnerable urban poor communities, in Phnom Penh and the provinces, who are affected by land and housing rights issues. STT is implementing four related projects: 1) Community Mapping, Housing Improvement and Research Project; 2) Land and Housing Rights Project; 3) Community Empowerment Project; and 4) Community Media and ICT Project. Each year to support the advocacy work of STT and other partner organisations, STT undertakes research into key issues affecting urban poor communities under threat of eviction. STT also has a strong focus on strengthening the advocacy capacity of community activists and providing a number of social media, ICT and land and housing rights trainings to urban and rural communities.

STT will ensure that all relevant information relating to training activities will be engaged in order to continue to advocate for communities’ land and housing rights.

2. Objective

The purpose of this consultancy is to develop training manual for facilitators/trainers and training booklets for the communities.

3. Expected Results and Deliverables

    • Before commencement of work the consultant is required to submit a final proposal including methodology, support strategy, work plan and budget, to STT
    • One Training Manual and one Community Booklet will be developed. This will provide a manual for all the instructions and technical materials needed to conduct a training course for trainers (ToT). Each manual will have a companion publication, Training Booklet, which will contain key messages, short guides, and other tools to be disseminated to communities.
    • Reports of the progress of the consultancy with verbal presentation of progress as appropriate.
    • A final report on work undertaken and presentation to relevant staff and stakeholders.

4. Methods and Activities

The consultant will provide STT with the following:

    • Develop organizational training manual and community booklet.
    • Provide training to specific staff members on how to use the manuals.
    • Receive comments from STT Management.
    • Submit a final report on the work undertaken.

Main responsibilities, Tasks and Activities

 

  • Make and collects payments by cash, cheque from/to employees/customers/donors
  • Maintains the petty cash fund, checkbook
  • Maintains and daily update the cash book
  • Prepare monthly cash reconciliation
  • Assist Finance Officer to make payments of tax relate expenditures
  • Assist Finance Officer in checking and reviewing all payment requests
  • Maintain all financial documents to make sure that those are in order files
  • Maintains safe and clean working environment by complying with procedures, rules and regulations
  • Contributes to team effort by accomplishing related results as needed
  • Carry out other functions assigned by the Finance Manager

 

Skills and Knowledge:

 

The post holder is expected to have:

  • Bachelor degree or fresh graduate in the field of Accounting or Finance
